What you agree to when you use Offload, and what we promise in return.

Acceptance of these terms

By downloading, installing, or using Offload ("the App"), you agree to these Terms of Service. If you don't agree, don't use the App. These terms are between you and Marcus Andrew Productions Inc. ("we", "us", "Offload").

What Offload is

Offload is a macOS application that helps real estate photographers organize photos and videos from SD cards by property address. It runs locally on your Mac. Some features (license verification, Google Calendar sync, address autocomplete) require an internet connection and our backend services.

Your license to use Offload

Subject to your active subscription or one-time purchase, we grant you a personal, non-exclusive, non-transferable license to install and use Offload on up to two (2) computers that you own or control. The license is for your own use — not for resale, sublicense, or distribution to others.

What you may not do

Account responsibilities

You're responsible for keeping your account credentials secure. Don't share your sign-in details. Notify us at support@arvaum.io if you suspect unauthorized access. You're responsible for all activity that happens under your account.

Subscription, billing, and cancellation

Free trial

Offload offers a 14-day free trial. No credit card is required to start the trial. At the end of the trial, the App will stop working unless you choose a paid plan from inside the App.

Paid plans

Prices are in U.S. dollars and exclude any sales tax or VAT, which may be added at checkout depending on your location. Payment is processed by Stripe.

Refunds

Monthly subscriptions: cancel anytime — we won't refund the current period but you won't be billed again. Lifetime purchases: we offer a 14-day refund window from the date of purchase if Offload doesn't work for you. Email support@arvaum.io with your purchase email.

Cancellation

Cancel from inside Offload (Settings → Subscription) or from your account portal at arvaum.io/offload-login. No fees, no questions asked.

Intellectual property

Offload — including all source code, user-interface designs, brand marks, and copy — is the property of Marcus Andrew Productions Inc. and is protected by U.S. and international copyright and trademark law. Nothing in these terms transfers ownership of any of that to you.

Your photos and your files

You own your photos. We never see them. Offload reads files from your SD cards and copies them to destinations you pick on your own drives. Your photos never travel through our servers and we have no copy of them. Ever.

Third-party services

Offload integrates with external services (Google Calendar, Google Places, Stripe). Your use of those services is governed by each provider's own terms and policies. We're not responsible for outages, bugs, or policy changes in those services, but we'll do our best to keep Offload working with them.

Updates and changes

We may release updates that add, change, or remove features. Critical updates (security, compatibility) may be installed automatically. We'll do our best to never break existing workflows without warning, but software changes — especially in early versions — sometimes require us to.

Service availability

We aim to keep our license server and account portal available 24/7, but we don't guarantee uninterrupted service. Offload caches your license status for up to 72 hours, so brief outages of our servers won't stop you from working.

Disclaimers

Offload is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties — express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the App will be error-free, will meet your specific needs, or will work uninterrupted on every system.

Always keep your own backups of original files. Offload copies files to the destinations you specify, but you're responsible for verifying that the copies are intact before reformatting your SD cards or deleting originals.

Limitation of liability

To the maximum extent permitted by law, in no event shall Marcus Andrew Productions Inc., its affiliates, or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of revenue, or business interruption — arising out of or related to your use of (or inability to use) Offload, even if we've been advised of the possibility of such damages. Our total liability for any claim arising under these terms shall not exceed the amount you've paid us in the twelve (12) months before the claim.

Indemnification

You agree to indemnify and hold harmless Marcus Andrew Productions Inc. from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of Offload in violation of these terms or any law.

Termination

You can stop using Offload at any time. We may suspend or terminate your license if you materially breach these terms — typically only after we've contacted you and given you a chance to fix the issue. On termination, the rights granted to you here end, but the disclaimers and limitation of liability sections survive.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute arising from these terms or your use of Offload will be resolved in the state or federal courts located in San Bernardino County, California, and you consent to the personal jurisdiction of those courts.

Changes to these terms

We may update these terms from time to time. Material changes will be announced inside the App and via email to registered users. Continued use of Offload after the effective date of an update means you accept the revised terms.
